Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs the use of the MobileXY Platform, Products and Services, including but not limited to MobileXY eSIMs and MobileXY Virtual Numbers.

This AUP forms an integral and binding part of the MobileXY Terms of Service. Capitalised terms not defined herein shall have the meaning set forth in the Terms of Service. In the event of any conflict, the Terms of Service shall prevail.

By using the MobileXY Platform, Products or Services, you acknowledge that you have read, understood, and agreed to this Acceptable Use Policy.

1. Purpose of This Policy

The purpose of this AUP is to:

(a) ensure lawful, fair, and responsible use of MobileXY Products and Services;

(b) protect MobileXY, its Users, partners, and third parties from abuse, fraud, and misuse;

MobileXY may, at its sole discretion, determine whether a User's conduct violates this AUP.

2. General Acceptable Use Principles

You may use MobileXY Products and Services only for lawful purposes and in a manner that:

(a) does not violate applicable laws or regulations of any country in which you reside or use the Services;

(b) does not infringe the rights of others, including without limitation privacy, intellectual property, or consumer-protection rights;

Any use that is illegal, deceptive, abusive, or unreasonable is strictly prohibited.

3. Prohibited Activities

The following activities are prohibited when using MobileXY Products or Services, whether directly or indirectly:

(a) attempting to bypass, disable, or interfere with any technical, security, or operational measures of MobileXY, including without limitation our automated fraud-detection and anti-abuse systems for the referral programme and other Promotional Programmes;

(b) copying, reproducing, modifying, adapting, reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the MobileXY Platform, Products or Services or other Intellectual Property of MobileXY, or interfering with the Platform's performance or functionality;

(c) reverse engineering, testing, probing, or exploiting MobileXY Products or Services to identify limitations, vulnerabilities, or enforcement mechanisms — except as part of an authorised, written, vulnerability-disclosure programme agreed in advance with MobileXY;

(d) using MobileXY Products or Services in any manner that adversely affects, or is reasonably likely to adversely affect, their availability, stability, reliability, or performance, including without limitation by submitting malformed requests, automated traffic above reasonable rates, or coordinated load designed to disrupt the Platform;

(e) engaging in illegal, fraudulent, deceptive, or misleading activities or any other abusive conduct, including but not limited to: hacking into any aspect of the MobileXY Platform, Products or Services; spamming; distributing unsolicited email; unsolicited advertising; promotional information or other communications; transmitting or distributing viruses or other technologically harmful, destructive, malicious, spying, offensive or obscene materials, programs or codes; deploying harmful agents or mechanisms designed to disrupt functionality, harm, disable or collect information;

(f) creating or using a false, misleading, or anonymised identity with the intent to deceive MobileXY or third parties, or to evade the eligibility criteria of any Promotional Programme;

(g) reselling, sublicensing, leasing, assigning, distributing, making available, or otherwise providing MobileXY Products or Services to any third party, whether for consideration or free of charge, without the prior written consent of MobileXY;

(h) collecting, harvesting, scraping or otherwise extracting personal data of other Users or of third parties from the MobileXY Platform without their explicit consent;

(i) impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity;

(j) facilitating, encouraging, or promoting any activity prohibited under this AUP.

4. Prohibited Use of MobileXY Virtual Numbers

MobileXY Virtual Numbers are provided for lawful personal use and for receiving incoming SMS messages only.

In addition to the general prohibitions above, you shall not use, or attempt to use, a MobileXY Virtual Number for:

(1) Unsolicited or abusive communications, including but not limited to spam, bulk, mass, or automated messaging activities, whether commercial or otherwise;

(2) Impersonation or misrepresentation, including creating or using a Virtual Number to mislead others as to the identity of the User or the origin of messages;

(3) Bypassing geographic or carrier restrictions of third-party services, including using a Virtual Number to receive verification codes intended for a different jurisdiction in violation of the third-party service's terms;

(4) Automated or abusive usage patterns, including the use of scripts, bots, headless browsers, or other automated means to collect, extract, harvest, or exploit verification, authentication, or similar messages received on the Number;

(5) Abnormal or excessive usage patterns, even where message volume is not excessive, if such patterns reasonably indicate misuse, abuse, or attempts to evade enforcement;

(6) Resale, redistribution or sharing of Virtual Numbers with third parties, whether for consideration or otherwise, including operating a numbering inventory or providing SMS-receive services to others;

(7) Any activity that is illegal, fraudulent, deceptive, or otherwise inconsistent with the intended purpose of a MobileXY Virtual Number.

5. Compliance With Third-Party Policies

You are solely responsible for ensuring that your use of MobileXY Products and Services complies with:

(a) applicable laws and regulations; and

(b) the terms, policies, and rules of any third-party service or platform on which the MobileXY Products or Services are used, including without limitation messaging applications, social networks, financial-services providers, marketplaces, and verification gateways.

MobileXY does not control and is not responsible for third-party policies, restrictions, suspensions, or bans applied to your accounts or activity on such third-party services as a result of your use of a MobileXY Product or Service.

6. Monitoring and Enforcement

MobileXY reserves the right, but does not undertake the obligation, to monitor usage of its Products and Services in accordance with applicable data-protection laws, for compliance with this AUP. We may apply automated detection systems for this purpose.

If MobileXY determines, at its sole discretion, that a violation of this AUP has occurred or is likely to occur, MobileXY may, without prior notice, take one or more of the following actions:

(a) suspend, restrict, or terminate the User's Account;

(b) suspend, restrict, or terminate any MobileXY Virtual Number associated with the Account;

(d) freeze, debit, or zero-out the User's XY Coins balance where the activity displays patterns consistent with fraud, abuse of Promotional Programmes, or other malicious behaviour;

(e) apply contractual penalties in accordance with the Terms of Service, including the £850 contractual penalty applicable to misuse of Virtual Numbers;

(f) void any pending or paid referral payouts associated with the Account;

(g) take any other measures deemed reasonably necessary to protect MobileXY, its Users, partners, or third parties.

Such actions shall not give rise to any right of refund, compensation, or damages on your part.

You may request human review of any automated enforcement decision by contacting support@mobilexy.com. We will respond to such requests within a reasonable time.

7. Relationship to Other Agreements

This AUP does not limit MobileXY's rights under:

(a) the Terms of Service;

(b) the Privacy Policy;

(d) any other agreement between MobileXY and the User.

Any violation of this AUP constitutes a material breach of the Terms of Service.

8. Changes to This Policy

MobileXY may update or modify this Acceptable Use Policy at any time by publishing a revised version on the MobileXY Platform. Continued use of MobileXY Products or Services after such publication constitutes acceptance of the updated AUP. The Effective Date at the end of this document indicates when the most recent revision took effect.
